1. Preamble

The Bruneau company provides customers with a personal environment called a 'Bruneau account'. This environment is accessible to the contact person(s) designated as such by the customer on the website www.bruneau.be/en/.

The Bruneau account enables our customers to get access to the following features:

  • creating a profile with information about the customer as a legal entity and one or more contact persons of the customer;
  • ordering online;
  • monitoring the preparation and delivery of orders;
  • consulting the data of the last orders and the corresponding invoices;
  • benefiting from exclusive advantages that can be used immediately with current orders;
  • obtaining personalised quotes;
  • creating online shopping lists;
  • consulting statistics based on analysed orders at a frequency chosen by the customer;
  • setting preferences for receiving advertising and promotional messages (newsletter, catalogue, etc.);
  • creating its own automatic rule for the approval of orders, based on conditions defined by the customer.

This document is specific to this environment. Other contractual documents regarding customers of Bruneau, such as order forms, general sales conditions, policy for the protection of personal data of customers and contacts and the cookie policy, are not limited or replaced by this document.

2. Purpose

The purpose of these special conditions is to set out and communicate the conditions for creating and using a Bruneau account on the www.bruneau.be/en/ website.

These special conditions apply to the customer regardless of whether he/she has made a purchase. When opening an account, the customer is granted the right to use his/her personal space and related services on the www.bruneau.be/en/ website.

3. Duration

The present special conditions come into effect when they are accepted by the contact person designated on the Bruneau account as the customer's representative as a legal person, from the moment the Bruneau account is created until it is definitively closed.

4. Enforceability

These special conditions are enforceable from the moment of their acceptance by the customer as a legal person, represented by the contact person who created the account, at the time the Bruneau account was created.

The Bruneau company reserves the right to make any changes to these special conditions which it deems necessary and useful. This version is legally binding for the user of the Bruneau account and can be consulted on our website www.bruneau.be/en/.

5. Creating a Bruneau account

To open a Bruneau account, you must first complete an online form which can be accessed via the www.bruneau.be/en/ website.

The procedure for creating a Bruneau account is carried out by a person appointed by the customer. Usually, this person is the administrator of the account, who has access and administrative rights.

The procedure for creating a Bruneau account via the online form includes the following steps:

  • Step 1: the administrator fills in the registration form. Fields marked with an asterisk are mandatory. The fields to be filled in relate to the customer as a legal entity and to the administrator himself. The information provided must be correct and regularly updated.
  • Step 2: the administrator acknowledges and accepts these special conditions by ticking off the checkbox provided for this purpose.
  • Step 3: once the form is correctly filled in, the administrator validates it and receives an email confirming the creation of the account on the email address he/she will have indicated when creating the account. The creation of the Bruneau account generates a customer code for the benefit of the legal entity customer.
  • Step 4: the administrator logs into the Bruneau account for the first time and completes the procedure by adding other contacts, saving one or more payment methods or setting a confirmation rule for orders.
6. Customer contacts

A Bruneau account is linked to a customer of the Bruneau company as a legal person. Each customer can link one or more contacts to the account, who can have different user rights:

  • The administrator has the right to use all available functions of the account, as described in the introduction. If the account has only one contact by default, this contact will be the administrator. However, it is possible to have several administrators for one account.
  • The user may only access the ordering functionality and not the other functionalities, which are reserved for the administrator(s) only.

The list of the respective contacts and their status can be consulted in the section 'Contacts linked to the account' of the Bruneau account.

7. Access to the Bruneau account

Access to the Bruneau account takes place via the address of the administrator or the customer code created at registration, regardless of which contact person decides to log in.

If several contacts are registered on the Bruneau account, the contact person concerned is asked to select his profile from the list of registered contacts after entering the login data and before opening the account. With this selection the use of the account is considered to be in his of her name.

8. Rights and obligations of contact persons

Even if the Bruneau account identifies a legal entity customer, use of the account is presumed to be on behalf of and in accordance with the rights of the contact person connected to the account.

In this respect, the contact persons are committed

  • not to misuse the account for purposes other than those for which it was created and made available to customers;
  • not to commit any act of counterfeiting, nor to reproduce, download, represent or modify all or part of the Bruneau account;
  • not to disrupt the proper functioning of the Bruneau account in any way.

In addition, contacts acknowledge that they are responsible for the preservation and confidentiality of their account login details and agree to take all necessary steps to ensure such confidentiality.

If you have forgotten your password, the administrator can create a new one by clicking on the 'Forgot password' link on the account login screen.

The administrator is also advised to change the password on a regular basis to ensure its effectiveness and security. The "My Password" feature of the Bruneau account allows for this.

9. Update of account information

Through the 'Profile' tab of the Bruneau account, account information can be updated in real time. In particular:

  • the password;
  • the contact details of the structure;
  • the contact details of the administrator(s);
  • the client's address book with the different possible addresses of the structure;
  • registered payment cards to facilitate the online ordering process, it being understood that card registration is not obligatory under any circumstances;
  • the list of contacts linked to the account, consisting of the surname and first name, address and rights of each of them;
  • the customer's preferences regarding print subscriptions and subscription to Bruneau newsletters.
10. Configuration of a validation circuit

The Bruneau account allows the configuration of an order validation procedure which allows, either by default for all orders or for orders above the amount determined by the customer, to request validation from one or more contacts registered in the account.

To set up a validation circuit, the administrator must go to the 'Confirmation rule' tab and fill in the form. This form indicates the amount above which the rule applies and the contact person(s) who must approve the orders.

As with the other fields to be filled in, the recorded validation rules can be updated or deleted at any time according to the customer's needs.

11. Property

The structure of the Bruneau account as well as the content of the latter remain the entire property of the Bruneau company. The data and content provided by the customer via the contact person(s) linked to the account and necessary for its administration remain their property.

12. Evidence convention

Connection records, logbooks and other technical data shall be considered by the Parties as having evidential value. This provision shall be regarded as an agreement of evidence.

13. Personal data and cookies

Bruneau acts in accordance with the regulations relating to the protection of personal data, in particular the General Data Protection Regulation, and the recommendations of the Data Protection Authority.

For more information, Bruneau customer contacts can refer to the personal data protection policy adopted by Bruneau by clicking here.

14. Nullity

If one or more of the stipulations herein are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations shall retain all their force and scope.

15. Applicable law and jurisdiction

These special conditions are governed by Belgian law. This applies to both substantive and formal rules, notwithstanding the execution venues of the substantive or ancillary obligations.

The Belgian courts are competent to take cognisance of any dispute relating to these special conditions.
